Terms & Conditions

These Terms & Conditions (“Terms”) govern the provision of home care services by House of Derion (“we,” “our,” “us”) to clients (“you,” “your”). By engaging our services, you agree to these Terms.
1. Services

We provide non-medical in-home care services including personal care, companionship, homemaking, medication reminders, respite care, and specialized care as agreed.

All services are delivered in compliance with Virginia laws and regulations applicable to home care organizations.
2. Licensure & Compliance
-
We are licensed under Virginia’s Rules and Regulations for the Licensure of Home Care Organizations (12 VAC 5-381) and any applicable statutes under Title 32.1, Chapter 5, Article 7.1 of the Code of Virginia.

We carry required liability insurance and fidelity bonds (or third-party crime insurance) as required by Virginia law.

Employees and caregivers are subject to background checks, required state training, and credentialing in accordance with Virginia law.
3. Client Obligations & Consent

You will provide accurate medical, personal, and living condition information so we can deliver safe care services.

You consent to allow our caregivers to enter your home to deliver services per the agreed plan.

You agree to follow any home safety guidance we provide.
4. Plan of Care & Changes

A written care plan will be established before services begin, including nature/frequency of services, goals, and duties.

The plan may be reviewed and modified with your agreement if your condition or needs change.
5. Fees, Billing & Payment

Fees are as stated in our service agreement. We will provide a schedule of fees & charges before care begins.

We will tell you which services are and are not covered by insurance or third-party payers.

Payment terms, cancellation, and refund policy will be clearly stated in writing.
6. Cancellation & Termination

Either party may cancel or reduce services with [insert number] days’ written notice.

We may terminate services if you no longer meet eligibility criteria, pose safety risk, or do not comply with payment.
7. Confidentiality & Privacy

We protect your personal, medical, and financial records in accordance with Virginia law and HIPAA (if applicable).

Any sharing of information is done only with your consent or as required by law.
8. Complaints & Grievances

We maintain a complaint procedure: how to file, how they’re handled, and expected timelines.

You have the right to voice grievances without fear of reprisal.
9. Liability Limitations

We perform our services with reasonable care. However, we are not responsible for harm arising from causes beyond our control (e.g. client’s failure to follow safety recommendations, pre-existing conditions unknown to us).

Our liability for damages is limited to the extent allowed by Virginia law.
10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia.

Any dispute arising under these Terms shall be resolved via [mediation/arbitration / or court], in accordance with Virginia statutes.
11. Amendments

We may change these Terms at any time. If we do, we will notify you in writing at least 30 calendar days before changes take effect.
