Privacy Policy

1. Purpose
This Privacy Policy explains how House of Derion (“we,” “us,” “our”) collects, uses, discloses, and protects your personal information. It also describes your rights under Virginia law, including the Virginia Consumer Data Protection Act (VCDPA) and state health information privacy regulations.

2. What Information We Collect
We may collect the following kinds of personal information:

  • Health Information: medical history, treatment records, medications, diagnoses.

  • Personal Identifiable Information (PII): name, address, phone number, email, date of birth.

  • Sensitive Data as defined under VCDPA: such as health data, maybe biometric info, etc.

  • Insurance and Billing Information: insurance provider, policy numbers, billing details.

  • Contact Information: emergency contacts, family details.

  • Usage & Technical Data if applicable (for example, website analytics, etc.).
     

3. How We Use Information
We use your information to:

  • Provide care and treatment and coordinate services.

  • Process billing, insurance claims, and payments.

  • Communicate with you, your family, or authorized representatives.

  • Maintain and improve our services.

  • Comply with legal obligations (e.g., reporting, audits) under Virginia state law and federal law.

  • If you consent, for purposes such as marketing or outreach.


4. When & With Whom We Share Information
We may share personal information when necessary:

  • With health care providers or specialists involved in your care.

  • With insurance companies or payers.

  • With our business partners or vendors who work on our behalf (e.g. billing or IT services), under confidentiality agreements.

  • When required by law (court orders, public health authorities).

  • With your written authorization for other uses beyond treatment, payment, or operations.


5. Your Rights under Virginia Law
Under the Virginia Consumer Data Protection Act and Virginia health information privacy laws:

  • You have the right to access your personal data.

  • You can correct inaccurate data.

  • You may delete certain personal data, subject to exceptions (e.g. legal obligations).

  • You have the right to opt out of certain processing (if applicable), especially sensitive data or sharing.

  • You have the right to receive information about how your data is handled and with whom.

  • You have the right to request restriction on certain uses or disclosures.


For health records, Virginia law (for example, § 32.1-127.1:03) provides that individuals can inspect their health records, obtain an audit trail of additions, or request corrections.

We will respond to your request within 45 days, or sometimes up to 90 days if an extension is needed. If we cannot comply with your request, we will explain why and how you may appeal. This is required by VCDPA. 
 

7. Security of Your Information
We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, alteration, or destruction.
Examples may include:

  • Secure storage of physical records.

  • Access controls and encryption of electronic data.

  • Training for staff and caregivers in privacy and confidentiality practices.


8. Retention of Data
We keep personal and health information as long as necessary to provide you care, meet legal obligations, and for record-keeping requirements under Virginia and federal law. Once data is no longer needed and required by law, we will securely dispose of it.

9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the new version on our website, and where required, send notice to our clients. The “Effective Date” at top will also be updated.

11. Applicable Laws
This policy is intended to comply with:

  • Virginia Consumer Data Protection Act (VCDPA) (Title 59.1, Chapter 53)

  • Virginia health records privacy laws (e.g. § 32.1-127.1:03) 

  • Federal law as applicable (e.g. HIPAA) if you handle protected health information under that regime.
